The wording of the rule suggests that there has to be a minimum of 3 CTs.
"The WARDEN cannot be the sole decider in these games. The WARDENS vote is the decider if there is a tie."
A tie implies there has to be 2 CTs OTHER than the warden. If there was only 2 CTs (one of which is the warden), then the warden's vote overrides the other CTs, regardless if there is a tie or not, and if the warden is the sole decider in a game in which Ts live or die, then favouritism comes into play.
